@DJRummel @Gold19468080 That argument has been tried in court (US. vs Whorely) and lost under that his loli collection was not protected under the First Amendment and was tried under obscenity laws. the PROTECT act is overbroad on purpose, and fictional child porn is not considered free speech.

@DJRummel @Gold19468080 The PROTECT act was made after Ashcroft vs. FSC who was able to successfully argue that persecution of fictional child porn is unconstitutional under the First Amendment, so PROTECT was written in direct response to fictional child porn, deeming it unprotected speech and obscene.
